Washington, DC is a separate jurisdiction from Washington State. Our earlier blanket claim that DC schedules both mitragynine and 7-hydroxymitragynine was not adequately supported. District statutes and regulations must be checked separately, and we are not treating ordinary kratom leaf and concentrated 7-OH products as having an established identical legal status.

Correction to the earlier blanket ban claim

Our previous page said that both mitragynine and 7-hydroxymitragynine were controlled in the District and treated that as a blanket ban on all kratom. We have removed that assertion because the sources reviewed do not adequately support it. This correction is not a determination that a particular product is lawful.

Check both statutes and municipal regulations

The District's Controlled Substances Act is a primary source for the statutory framework. Looking for a compound in that text alone is not a complete review of District rules; municipal regulations and later amendments also matter.

The Legislative Analysis and Public Policy Association's February 2026 state-law report, printed page 24 identifies a 7-hydroxymitragynine regulation in 22-B DCMR § 1201 and explains uncertainty around the treatment of natural kratom. It does not support our earlier claim that both alkaloids are scheduled. This secondary analysis is dated and does not establish the current status of a particular product.

Before acting, obtain the current applicable regulation and any amendments from District authorities or a qualified legal professional. Check the product's actual composition and the activity involved, such as possession, retail sale, or shipment. Do not assume that a source about concentrated 7-OH answers every question about botanical leaf.
